1. Acceptance of Terms

By accessing and using the Big Island Custom Sheds website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Estimates and Pricing

All quotes and estimates provided through our website are preliminary and subject to change. Final pricing may vary based on:

• Actual material costs at time of purchase
• Site conditions and accessibility
• Permit requirements and fees
• Customer-requested modifications
• Unforeseen circumstances or complications

A final, binding quote will be provided after site evaluation and material pricing confirmation. Estimates are valid for 30 days from the date of issue.

3. Payment Terms

Payment terms are as follows:

• Full payment is required upfront before materials are ordered and construction begins
• Payment must be received in full before any work commences
• We accept payment via bank transfer (ACH), credit card, check, or wire transfer
• All payments are non-refundable once materials have been ordered
• Payment processing fees may apply for credit card transactions

4. Permits and Code Compliance

The customer is responsible for:

• Obtaining all necessary building permits and approvals
• Ensuring compliance with local building codes and zoning regulations
• Verifying property boundaries and setbacks
• Marking utility lines and underground services
• Any permit-related fees or costs

Big Island Custom Sheds will build to code specifications, but obtaining permits is the customer's responsibility. We recommend consulting with local building authorities before proceeding.

5. Site Preparation

The customer is responsible for site preparation, including but not limited to:

• Clearing and leveling the construction site
• Providing adequate access for delivery vehicles and equipment
• Ensuring utilities are marked and accessible if needed
• Removing obstacles that may impede construction
• Preparing foundation area if required

6. Construction Timeline

Estimated construction timelines are provided for planning purposes only. Actual completion dates may vary due to:

• Weather conditions and delays
• Material availability and delivery schedules
• Permit processing times
• Site accessibility and conditions
• Unforeseen complications

Big Island Custom Sheds is not liable for delays beyond our reasonable control.

7. Warranty and Liability

Workmanship Warranty: Big Island Custom Sheds provides a limited warranty on workmanship for a period of one (1) year from the date of completion. This warranty covers defects in construction but does not cover:

• Normal wear and tear
• Damage from misuse, abuse, or neglect
• Damage from acts of nature, including but not limited to storms, floods, earthquakes, or fires
• Damage from pests or animals
• Modifications made by the customer or third parties
• Damage to customer-provided materials

Materials Warranty: Materials are covered by manufacturer warranties. Big Island Custom Sheds will facilitate warranty claims but is not responsible for manufacturer defects.

Liability Limitation: Big Island Custom Sheds is not responsible for damage to existing structures, landscaping, utilities, or personal property. The customer assumes all risk for site-related issues and is responsible for proper site preparation and utility marking.

8. Cancellation and Refunds

Once materials have been ordered, all payments are non-refundable. If cancellation occurs before materials are ordered, a cancellation fee may apply. Changes to the project scope after materials are ordered may result in additional charges.

9. Limitation of Liability

To the maximum extent permitted by law, Big Island Custom Sheds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from the use of our services.

10. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Hawaii County, Hawaii.

11. Changes to Terms

Big Island Custom Sheds reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
